1. Introduction

Welcome to My Courtesy Bus. These Terms of Service govern your use of our website and services, operated by Spoke Technologies.

By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.

2. Definitions

For the purposes of these Terms of Service:

  • "Service" refers to the My Courtesy Bus website and transportation booking platform.
  • "User" refers to anyone who accesses or uses the service, including venue administrators and passengers.
  • "We", "Us", "Our" refers to Spoke Technologies.
  • "Venue" refers to the business entity that contracts with us to provide transportation services to their members.
  • "Member" refers to individuals associated with a Venue who are eligible to use the transportation services.

3. Account Registration

To access certain features of the Service, you may be required to register for an account. You must provide accurate, current, and complete information during the registration process and keep your account information up-to-date.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Service Usage

Our Service allows Venues to manage transportation services for their Members. As a Venue, you may:

  • Create and manage transportation schedules
  • Add and manage Members who can book transportation
  • Monitor transportation activity
  • Manage administrative rights and permissions

As a Member, you may:

  • Book transportation within the parameters set by your Venue
  • Receive notifications about your bookings
  • Track transportation in real-time
  • Manage your personal profile

5. Booking and Cancellation

5.1 Booking Policy: All transportation bookings are subject to availability and must be made through the Service. Bookings are confirmed only when you receive a confirmation notification.

5.2 Cancellation Policy: Cancellations must be made at least two (2) hours before the scheduled pickup time. Late cancellations may be subject to penalties as determined by the Venue.

5.3 No-Shows: Failure to be present at the designated pickup location at the scheduled time without prior cancellation may result in restrictions on future bookings.

6. Venue Responsibilities

Venues using our Service agree to:

  • Provide accurate and complete information about their transportation requirements
  • Ensure that only authorized individuals are given access to admin functions
  • Promptly respond to Member inquiries and concerns regarding transportation services
  • Comply with all applicable laws and regulations related to transportation services
  • Pay all fees and charges associated with the Service in a timely manner

7. Member Conduct

Members using our transportation services agree to:

  • Be ready at the designated pickup location at the scheduled time
  • Treat drivers and other passengers with respect
  • Refrain from behavior that could distract the driver or compromise safety
  • Not consume alcohol or illegal substances during transportation
  • Follow all safety instructions provided by the driver
  • Report any issues or concerns promptly to their Venue or to us

8. Intellectual Property

8.1 Our Content: The Service and its original content, features, and functionality are owned by Spoke Technologies and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

8.2 Your Content: You retain any rights to data you submit to the Service. By submitting content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content in connection with providing and promoting the Service.

9. Limitation of Liability

9.1 To the maximum extent permitted by law, Spoke Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Unauthorized access, use, or alteration of your transmissions or content
  • Delays or disruptions in transportation services

9.2 Our liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the liability.

10. Termination

10.1 We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

10.2 Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

11. Governing Law

These Terms shall be governed by the laws of Queensland, Australia, without regard to its conflict of law provisions. Any disputes relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Queensland, Australia.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
